Code Officials Qualification Board

  1. Notice is hereby given in accordance with G.S. 150B-21.2 that the NC Code Officials Qualification Board intends to amend the following agency rules:

    The proposed notice of text changes are published in the North Carolina Register dated August 15, 2017.

    The comment period for this proposed rule amendment ends October 16, 2017. A public hearing was held on July 25, 2017 with no public comments received.

Procedure for Subjecting a Proposed Rule to Legislative Review:

If an objection is not resolved prior to the adoption of the rule, a person may also submit written objections to the Rules Review Commission. If the Rules Review Commission receives written and signed objections in accordance with G.S. 150B-21.3(b2) from 10 or more persons clearly requesting review by the legislature and the Rules Review Commission approves the rule, the rule will become effective as provided in G.S. 150B-21.3(b1). The Commission will receive written objections until 5 p.m. on the day following the day the Commission approves the rule. The Commission will receive those objections by mail, delivery service, hand delivery, or facsimile transmission. N.C. Gen. Stat. §150B-21.3A, adopted in 2013, requires state agencies to review existing rules every 10 years. An initial review will be completed during the next five years, and thereafter rules will be reviewed on a 10-year review cycle. The NC Department of Insurance’s rules are located in Title 11 of the NC Administrative Code. Rules under Title 11 will be reviewed on a schedule established by the Rules Review Commission. The rules from Chapter 12 of Title 11 are currently under review and available for comment September 13, 2018 – November 16, 2018:

The Department of Insurance is required to evaluate each of the existing rules and make an initial determination from one of these three classifications:

  • Necessary with substantive public interest – the agency has received public comment on the rule within the past two years or the rule affects the property interest of the regulated public, and the agency knows or suspects that any person may object to the rule.
  • Necessary without substantive public interest – the agency determines that the rule is needed, and the rule has not had public comment in the last two years. This category includes rules that identify information that is readily available to the public, such as an address or telephone number.
  • Unnecessary – the agency determines that the rule is obsolete, redundant or otherwise not needed.

The NC Code Officials Qualification Board has the primary duty of certifying Code Enforcement Officials (CEOs) in North Carolina. No city, county, or state agency inspector may enforce the State Building Code without being certified by the Qualification Board.The 20 member Board is composed of engineers, contractors, inspectors, architects, educators, and city, county, and state officials.

Individuals seeking to become certified as Building, Fire, Electrical, Mechanical and Plumbing CEOs to perform inspections for city, county or state agencies should read the applicable "How do I become an inspector…" bulletins below for the technical area they are interested in.

Authorities Having Jurisdictions (AHJs) and NC Community Colleges offering COQB Standard Courses

Individuals interested in certification as Code Enforcement Officials (CEOs) in NC must successfully complete mandatory courses offered by the NC Community College System. All applicants for certification must pass the Law and Administration course as well as the Board’s Standard Course for the Trade Type and Level sought - such as Building, Level 1 (single-family residential and small business).
